These Terms of Service (“Terms”) are a legally binding agreement between you (“you,” “your,” or “User”) and DigiElo, Inc., a Delaware corporation (“DigiElo,” “we,” “us,” “our”). These Terms govern your access to and use of DigiElo's websites, mobile applications, and services, including DigiElo applications for iOS and Android (collectively, the “Services”).

NOTICE: These Terms include mandatory arbitration and a class action waiver (Section 23) and limit DigiElo's liability. Please read carefully.

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1) KEY DOCUMENTS INCORPORATED BY REFERENCE

These Terms incorporate by reference the following (collectively, “Policies”):

- DigiElo Privacy Policy

- DigiElo Community Guidelines

- Any other rules, product terms, or supplemental policies presented within the Services (e.g., feature-specific notices, beta disclosures)

If these Terms conflict with a Policy, these Terms control unless the Policy expressly

states otherwise.

2) ELIGIBILITY

Adults Only. The Services are intended for adults. You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you are at least 18

years old and have legal capacity to enter into these Terms.

3) DEFINITIONS

“Account” means your DigiElo account.

“App” means DigiElo's iOS and/or Android application(s).

“Content” means all text, images, audio, video, messages, listings, prompts, data, AI outputs, and other materials made available through the Services.

“User Content” means Content you submit, upload, post, message, transmit, publish, or otherwise make available through the Services.

“DigiElo Content” means the Services and all Content provided by DigiElo, excluding User Content.

“Elo” means optional AI-assisted features (prompts, summaries, recommendations, suggestions, or outputs).

“Hello Zone / Hot Zone” means proximity-based discovery and interaction features.

“Verification” means identity verification, liveness checks, credential validation, or related integrity processes.

“Third-Party Services” means services not controlled by DigiElo, including app stores and vendors.

4) ACCOUNT REGISTRATION AND SECURITY

You agree to provide accurate information and keep it updated. You are responsible for all activity on your Account. You may not transfer your Account. If you suspect unauthorized access or security issues, notify us immediately at info@digielo.com.

5) PLATFORM AVAILABILITY (iOS AND ANDROID) AND APP STORES

DigiElo intends to make the Services available on iOS and Android, subject to device compatibility, regional availability, and platform policy compliance. Availability may vary by region and may change at any time.

Apple and Google are not parties to these Terms and are not responsible for the Services, except as required by law.

We may update, modify, suspend, or discontinue any part of the Services at any time. Some updates may be required to continue using the Services.

6) VERIFICATION; INTEGRITY; NO GUARANTEE

Verification may be required for certain features. You agree not to misrepresent your identity or provide false information.
